California Governor Gavin Newsom including California Attorney General Rob Bonta have now filed a lawsuit against President Donald Trump.
Newsom and Bonta challenged Trump’s use of emergency powers which are used to put tariffs into place which eventually is known to hurt business, consumers, and states.
The lawsuit accuses Trump of holding lack of authority since he plans to enact these tariffs through the Economic Emergency Power Act.
Newsom believes that these tariffs will create immediate damage towards California, which could harm the U.S. economy in general since California is the largest economic, manufacturing, and agricultural state in the nation.
As people saw, when these tariffs were initially put in place, the tariffs disrupted the chain of supply, which inflated costs for all states, and more importantly in this case, Californians.
The lawsuit initially argues that Trump lacks any sort of authority with the economy when he chose to impose these tariffs on Mexico, Canada, and China.
Though in this case, Trump argues that the IEEPA gives the president the authority to do any of this in the first place, so he is able to do things like declare a national emergency against foreign policy or economic threats.
This lawsuit tells the tale of the U.S., The Supreme Court, and how they question major doctrine which holds a lot of significant social and economic tendencies.
Within the recent years of the Court, they applied this similar standard mainly to strike down any major incentives that they withhold.
This includes former President Barack Obama’s Clean Power Plan and former President Joe Biden’s student loan forgiveness program.
So when we look at how California is more of the backbone of our economy, statistically, California grosses 3.9 trillion dollars in the year 2023 alone making it fifty percent bigger than Texas’s GDP.
Yet California still sends 83 billion dollars to the federal government, making California the center of practically everything in terms of economy also alluding to the fact that California alone employs over 1.1 million Americans.
As getting rid of tariffs has been extremely popular amongst Americans across the nation, many news sources have begun saying how it was “necessary” that Newsom is suing Trump.
Most of the lawsuit is more of a testament to how Trump should’ve received a judicial ruling on whether or not a president can raise tariffs without the congressional approval to do it.
To continue this lawsuit, Newsom has already decided to work with other multiple state governors on this issue, meaning Trump would have a total fourteen lawsuits already filed against him and his tariff policy.
Though a lot of people have been saying this lawsuit is risky seeing as it can cause even more damage to California if Trump retaliates and withholds federal funding to the state which includes helping with rebuilding L.A from the fires.
And this isn’t some open ended threat as Trump in the past has pulled back from federal funding when it comes to certain universities and law firms that have opposed his policies.
Although this might seem simple, to the Supreme Court it isn’t, therefore congress and the court won’t come up with a clear answer till later.
